Welcome to Luxora Real Estate, a data-based digital platform that connects Buyers, Renters/Tenants, and Property Owners. By accessing or using the Luxora platform and associated services (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms").

Please read them carefully, as they govern your use of all features and services provided through Luxora, including listings, 360° property services, property management, valuation, maintenance, and short-term rentals.

1. Definitions

1.1 "Luxora" refers to the digital platform operated by Luxora Real Estate, located at West Wing, Latifa Tower - Sheikh Zayed Rd - Trade Centre - Trade Centre 1 - Dubai - United Arab Emirates.

1.2 "User" refers to any individual or legal entity who accesses or uses the Platform, including Buyers, Renters/Tenants, and Property Owners.

1.3 "Property Owner" includes developers, brokers, and private owners listing properties for sale or rent.

1.4 "Buyer" includes individuals or entities interested in purchasing listed properties.

1.5 "Tenant/Renter" refers to any individual or entity leasing properties listed on Luxora.

1.6 "Services" includes but is not limited to listing viewing, property search, lead connection,

  • You must be at least 18 years of age or of legal age in your jurisdiction to use the Platform.
  • You must provide true, complete, and current registration information when signing up or using any part of our services.
  • Luxora reserves the right to suspend or terminate access for Users who violate these Terms or provide false information.

3. Platform Usage

3.1 Permitted Use

  • You may use the Platform only for lawful purposes and in accordance with these Terms.
  • Users may access property listings, submit inquiries, schedule property viewings, or use the service functionalities provided by Luxora.

3.2 Prohibited Use

  • Attempting to extract or scrape data from Luxora’s website or listings.
  • Posting fraudulent, misleading, or unlawful property listings.
  • Impersonating another user or individual.
  • Attempting to bypass security systems or damage Luxora’s systems.

3.3 Account Responsibility

  • Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their accounts.
  • Luxora is not liable for any loss or damage from unauthorized access.

4. Property Listings and Content

4.1 Accuracy of Listings

  • All listings must include accurate, updated information including property size, price, condition, and legal ownership.
  • Luxora does not own listed properties and only acts as an intermediary.

4.2 Verification

  • While Luxora may verify listings via its quality checks, Users must conduct their own due diligence before entering into any agreement.

4.3 Intellectual Property

  • All content uploaded by Users must be owned by them or they must have legal rights to post it.
  • Luxora holds the right to remove content that violates intellectual property laws.

5. Limitation of Liability

  • Luxora acts solely as a facilitator of property transactions and does not own or control listed properties.
  • We are not responsible for the conduct of Users, tenants, or owners.
  • Luxora will not be held liable for any direct, indirect, or incidental loss resulting from use of the Platform.
  • Users must engage lawyers or professional advisors before making real estate transactions.

6. User Conduct and Warranties

By using the Platform, you warrant that:

  • You are legally authorized to buy, rent, or manage property in the UAE.
  • You will not use the platform for unlawful or deceitful activities.
  • You grant Luxora a non-exclusive, royalty-free license to use, reproduce, and display any content you upload (e.g., property photos, descriptions).

7. User Conduct and Responsibilities

By using Luxora, you agree not to engage in activities that:

  • Violate any local, national, or international law or regulation.
  • Involve fraudulent or misleading listings, inquiries, or transactions.
  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation.
  • Collect or store personal data about other users without their express consent.
  • Introduce viruses, malware, or other harmful software or code.
  • Attempt to gain unauthorized access to any portion of the Platform, other accounts, computer systems, or networks.
  • Reverse engineer, decompile, or attempt to extract the source code or algorithms of Luxora.

Luxora reserves the right to suspend or terminate your access if any of these conditions are violated, with or without prior notice.

8. User Verification and Due Diligence

Luxora facilitates connections between buyers, renters, and sellers, butdoes not guarantee the authenticity of every listing, user, or agent. While we perform routine background checks and partner only with trusted developers and verified agents, users must conduct their own due diligence before entering into any transaction.

  • Property inspections, contract reviews, and third-party legal or financial advice are recommended.
  • Luxora is not liable for losses due to inaccurate listing details, agent misrepresentation, or developer-related disputes.

9. Fees, Payments, and Subscriptions

Some services provided on Luxora may require payment, including but not limited to:

  • Premium listings for sellers or developers.
  • Advertising placements.
  • Short-term rental management or tenant support packages.
  • Professional services (valuation, maintenance, photography, legal review).

Payment terms:

  • All fees are displayed transparently at checkout or upon subscription.
  • Payment is accepted in AED via approved local gateways.
  • Refunds are governed by the Refund Policy available on our platform.
  • Luxora reserves the right to revise prices, service offerings, or introduce new services without prior notice.
  • Non-payment or chargebacks may result in account suspension or legal proceedings.

10. Intellectual Property Rights

All content hosted, displayed, or distributed on the Luxora platform, including but not limited to:

  • Logos, brand elements, UI/UX designs.
  • Property images (unless uploaded by users).
  • Text, scripts, layouts, and code.
  • Guides, valuation tools, maps, and filters.

...are the exclusive intellectual property of Luxora Real Estate Platform or its content partners.

Users are prohibited from copying, reproducing, modifying, or distributing platform content without prior written permission from Luxora.

Exceptions:

  • Approved agents or partners may use platform materials under specific agreements.
  • Users may download content for personal, non-commercial use.

11. Property Availability and Accuracy Disclaimer

While Luxora strives to present accurate, up-to-date listings and service availability, we do not guarantee the continued availability, accuracy, or legality of any property displayed on the platform.

  • Properties shown may be subject to prior sale, rental, or withdrawal without notice.
  • Luxora is not responsible for discrepancies in pricing, location, dimensions, or other property specifications received from developers or partners.
  • We recommend buyers and tenants independently verify critical details, including ownership, title deeds, building approvals, and occupancy status through relevant legal or governmental channels.

12. Third-Party Developers and Broker Coordination

Luxora works as a digital bridge between buyers/tenants and authorized brokers, developers, or property managers.

  • We do not represent or act on behalf of all listed developers unless expressly stated.
  • Service requests such as property valuation, management, and maintenance may be outsourced to verified third parties.
  • Users understand that acceptance of services does not establish a contractual obligation with Luxora for performance guarantees.
  • Luxora shall not be liable for disputes between users and third-party developers, agents, or service providers unless directly caused by Luxora’s negligence.

13. Regulatory Compliance & UAE Real Estate Laws

Luxora operates in accordance with the UAE’s real estate and digital services regulations, including (but not limited to):

  • Dubai Land Department (DLD) guidelines
  • Real Estate Regulatory Authority (RERA) compliance
  • Applicable TRA (Telecommunications Regulatory Authority) and Data Protection standards

Luxora reserves the right to update procedures and services to remain compliant with regulatory changes. Failure to comply with applicable laws while using our platform may result in legal action.

14. Short-Term Rentals Clause

Users availing short-term rental assistance through Luxora acknowledge the following:

  • All short-term rental arrangements must comply with DTCM (Department of Tourism and Commerce Marketing) licensing in Dubai.
  • Luxora does not directly own or manage short-term units; it only facilitates legal rental connections via licensed parties.
  • Users agree not to sublease, misuse, or alter rented properties in a manner that violates tenancy or local laws.
  • Luxora will not be liable for penalties, evictions, or damages resulting from improper use of short-term rental properties.

15. Anti-Fraud and Identity Verification

To maintain integrity and trust on Luxora, the platform may require ID verification for service access, especially in high-value transactions (property purchase, valuation, etc.).

  • Submission of fake documents, impersonation, or unauthorized inquiries will lead to legal consequences.
  • We reserve the right to share suspected fraud information with legal authorities, banks, and law enforcement bodies.
  • Users agree to use the platform only for legitimate property research, purchase, or rental objectives.

16. Data Ownership and Platform Rights

Luxora owns all intellectual property and data structures related to:

  • Property categorization, area research, listing curation, valuation models, and service routing
  • UI/UX design, platform tools, and all software code and backend systems

Users may not copy, scrape, reverse-engineer, or reuse any of the above elements without explicit written permission. Violators will face legal action under UAE and international copyright and anti-piracy laws.

17. Use of Communication Tools (Email, WhatsApp, Phone)

Luxora may communicate with users via:

  • Email, SMS, WhatsApp, phone calls, or in-app notifications
  • These communications may include booking confirmations, follow-up queries, property updates, service recommendations, or promotional content
  • Users consent to receiving such communications while using the platform. To opt out of marketing messages, users may follow unsubscribe instructions included in each communication.

18. Limitations of Service Scope

Luxora is not a legal advisory, escrow provider, or financial consultant. We do not:

  • Guarantee property investment returns
  • Provide tenancy contract legal reviews
  • Offer escrow services or hold funds
  • Act as a real estate agent or certified property consultant unless otherwise explicitly mentioned

Users are strongly advised to consult licensed legal or financial professionals before entering into purchase, rent, or investment agreements.

19. Platform Updates and Service Interruptions

Luxora may periodically upgrade, patch, or reconfigure its website or backend systems, which may temporarily affect access or functionality.

  • Planned outages will be communicated in advance when possible.
  • Luxora is not liable for any business or financial losses caused by temporary service downtime, listing errors, or access delays.

20. Force Majeure

Luxora will not be held liable for failure or delay in performance due to circumstances beyond our control, including:

  • Acts of God, war, terrorism, cyberattacks
  • Changes in real estate laws
  • Server outages, data breaches, or power disruptions
  • Natural disasters or public health emergencies

21. Termination of Access

Luxora reserves the right to terminate or restrict access to users who:

  • Violate any part of these Terms & Conditions
  • Abuse communication tools
  • Engage in misleading or fraudulent inquiries
  • Cause harm or disruption to Luxora’s platform, staff, or third-party partners

Termination may be temporary or permanent, depending on the nature of the violation.

22. Data Protection and Privacy

Luxora adheres to UAE data privacy regulations. For details on how we collect, use, store, and protect your data, please refer to our Privacy Policy (to be provided separately).

23. Changes to the Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on the platform, and where necessary, communicated via email.

Continued use of the platform after such updates constitutes acceptance of the revised Terms.
